Prices
Prices are subject to change without notice. Orders are accepted at pricing in effect on date of shipment. To guarantee pricing for a specific period, you must obtain a written quotation from DS agencies Pty Ltd. Using this site and/or submitting an order does not constitute an offer to sell. All pricing includes 10% GST.
Payment
All accounts are due and payable in Australian funds according to the terms of the invoice. Payments by credit card are accepted with an additional processing charge unless purchased online through this site. All credit card orders are pre-authorised at the date of the purchase order; however, except in the case of custom orders, payment is not charged until the order ships. Prepaid orders are accepted when paid with a company cheque or EFT (information available upon request).
Ordering
Because of the specific nature of our products and our commitment to shipping (or filling) orders accurately, we prefer that orders be placed online or in writing via a purchase order. However, we will make every effort to take accurate orders verbally when requested by the customer. We cannot guarantee that verbal miscommunication errors will result in the purchaser's favour.
Order Confirmation
Customers will receive a written confirmation of their order. If you do not receive confirmation of your order, please contact us as it is possible we did not receive your original order. Please review the confirmation to ensure the details of the transaction (item numbers, quantities, ship-to address, pricing, ship method and approximate ship date) are as you expected and notify us of any discrepancies as soon as possible.
Backorders
Backorders are fulfilled via our normal supply process; however backorders can be air freighted for an additional charge.
Changes
The fulfilment process commences upon receipt and entry of the purchase order, therefore, it is frequently not possible to change orders.
Delivery
All products ship FIS General Freight to Australian mainland capital city metro areas only. All other shipping costs and risks of freight damage are the responsibility of the purchaser. Any claims for shortages or damages are the responsibility of the purchaser. Any claims for shortages or damages, concealed or otherwise, must be made immediately on receipt of product. See freight damage policy below. All promises of delivery are made in good faith and every reasonable effort is made to see that delivery schedules are met. However, if we are unable to meet a schedule due to factors beyond our control, DS agencies Pty Ltd will not be responsible for significant or specific damage. Significant or specific damage is, but not limited to, express shipping method charges or installation delay charges. Any of the sales staff at DS agencies Pty Ltd would be glad to quote delivered prices based on your specific requirements or needs. Delivered prices do not include any type of extraordinary charges such as lift gate requirements, inside delivery charges, residential charges or any other non-standard charges which apply. This is an estimate of total freight charges.
Special Orders
Any product not normally carried in inventory could be subject to an additional charge and may not be returned. All electrical products are treated as special order items. Call DS agencies Pty Ltd for information on special or custom applications.
Specifications
DS agencies Pty Ltd and Universal Mounting Solutions is constantly developing new products and making improvements to existing ones; therefore, we reserve the right to revise or change specifications, designs and model numbers and to discontinue models without notice.
Freight Damage
It is the receiver's responsibility to immediately open and inspect all packages and, in the event there is any damage, file a claim with the freight company. Please contact DS agencies Pty Ltd to get contact information about the specific freight company used and to discuss receiving a replacement product. Keep the damaged product in its original packaging and carton. Unless concealed damage is reported to the Carrier and DS agencies Pty Ltd immediately, there is no recourse. The customer will be charged for any replacement product as the eventual credit will come directly from the carrier via the claim filed.
Returns Authorisation
All merchandise returned must be returned with prior authorisation and a Return Authorisation number provided by Customer Service. Defective or product received incorrectly due to an error on our part will be credited to your account in full. In situations where the dealer needs to return merchandise due to a change in its project or the equipment to be mounted or, in the event, the dealer has ordered incorrectly, a restock charge will apply as follows. Merchandise invoiced in the past 30 days, 20% 31-60 days, 25% 61-90 days, 40%. However, consideration for reduced fees may be given for an accompanying reorder. Returns are not allowed for merchandise over 90 days old; electrical and other lift products; special order products, and discontinued merchandise. For merchandise that is returned damaged or with missing parts, no credit will be given or, in cases where the merchandise can be made saleable, charges for parts and labour will be charged in addition to the restock fee.
Limited Warranty
With the exception of electric, gas cylinder and one-way bearing mechanisms, Universal Mounting Solutions and DS agencies Pty Ltd warrants its products to be free of defects in material and workmanship for 5 years. Electrical mechanisms (such as lift products) have a 1-year limited warranty. Gas cylinder and one-way bearing mechanisms have a 1 year limited warranty. All warranties are in effect for the original purchaser only. Universal Mounting Solutions and DS agencies Pty Ltd disclaim liability for any modifications, improper installation and/or installations over the specified weight capacity. Universal Mounting Solutions and DS agencies Pty Ltd also disclaims liability for any modifications made to electrical mechanisms, improper installation, incorrect voltage connection and/or installations over the stated weight capacity. All Electrical Mechanisms are intended for indoor use only and failure to comply will void warranty. DS agencies Pty Ltd sole warranty obligation to the owner of its products is to repair or replace (at our discretion) defective products at no charge to the original purchaser within the warranty period. The purchaser is responsible for returning the product to Universal Mounting Solutions via prepaid shipping.
To the maximum extent permitted by applicable law, DS agencies Pty Ltd disclaims any other warranties, express or implied, including warranties of fitness for a particular purpose and warranties of merchantability. DS agencies Pty Ltd will not be liable for any damages whatsoever arising out of the use or inability to use Universal Mounting Solutions products, even if Universal Mounting Solutions and DS agencies Pty Ltd has been advised of the possibility of such damages. Universal Mounting Solutions and DS agencies Pty Ltd bears no responsibility for incidental or consequential damages. This includes, but is not limited to, any labour charges for the repair of products performed by someone other than a Universal Mounting Solutions and DS agencies Pty Ltd employee or representative. Because some states and jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, the above limitation may not apply. DS agencies Pty Ltd will not be responsible for damage to Universal Mounting Solutions products caused by misuse, abuse, failure to properly package the product for return for damage caused by carriers during shipment to or from our Warehouse(s). Any repairs to Universal Mounting Solutions products required due to misuse, abuse or shipping damage or repairs of defective product outside the warranty period will be performed at the current rates established by DS agencies Pty Ltd for factory service.
General Provisions
a. Entire Agreement/No Waiver. These Terms of Use constitute the entire agreement of the parties with respect to the subject matter hereof. No waiver by DS agencies Pty Ltd of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or default.
b. Correction of Errors and Inaccuracies. The Content may contain typographical errors or other errors or inaccuracies and may not be complete or current. DS agencies Pty Ltd therefore reserves the right to correct any errors, inaccuracies or omissions and to change or update the Content at any time without prior notice. DS agencies Pty Ltd does not, however, guarantee that any errors, inaccuracies or omissions will be corrected.
